Proposed New Local Form Chapter 13 Plan

On January 3, 2017, the Committee on Rules of Practice and Procedure accepted a recommendation from its Advisory Committee on Bankruptcy Rules for final approval of a package of rule amendments, a new rule and an Official Plan form (new Official Form 113) for use in chapter 13 cases. The recommendation was approved by the Judicial Conference at its March 2017 meeting, and adopted by the Supreme Court by Order dated April 27, 2017. The form and related rules will go into effect December 1, 2017.

Under amended Fed. R. Bankr. P. 3015(c), Official Form 113 is required to be used in federal districts after the effective date unless, after public notice and opportunity for comment, the district adopts a local Chapter 13 form plan that meets the requirements listed in new Rule 3015.1. The Judges of the Western District of Louisiana intend to adopt the use of a Local Form Chapter 13 Plan (“Local Plan”) and hereby give public notice of same. The court has approved a public comment period of 60 days during which the public is encouraged to submit written comments, favorable, adverse, or otherwise, via email to bankruptcy_comments@lawb.uscourts.gov. All comments should be submitted no later than August 14, 2017. All comments on the proposed Local Plan will be carefully considered.
